Prof. Dr. Heiko Höfler, a partner in Orrick's Frankfurt office, is the head of the German Energy and Infrastructure Group. He advises and represents public authorities and private entities in and out of court in public and private infrastructure, IT and energy matters. He is also an honorary professor at Bauhaus-University, Weimar, where he teaches public procurement law and the law of pubic private partnerships.
He has been practicing as a lawyer since 1995 and served as counsel in numerous review procedures leading to landmark decisions of the Public Procurement Boards and Courts. Recently he represented a public private partnership before the European Court of Justice and a market-leading German company before the Federal Constitutional Court.
Together with his team of experts he advised public authorities, bidders and investors on several PPP-projects in the recent years. Among others, he advised a consortium as a bidder in the, by far, largest competitive dialogue in Germany and the successful bidder in the pilot project "Justizzentrum Chemnitz," which was awarded by the State of Saxony.
Furthermore, his practice extends to advising foreign investors, project developers and technology providers on investments in the Federal Republic of Germany. Heiko Höfler was involved as external counsel in one of the largest European railways services transactions in 2010/2011. He recently advised a global provider of X-ray security systems in its entry into the German market. In the field of renewable energy, he advised a U.S. investor on the realization of a large-scale photovoltaic project.
He is the author of a large number of publications and a frequent lecturer at numerous conferences relating to public procurement law and the law of public private partnerships (PPP).
