Dr. Peter Braun is an of counsel in Orrick's Frankfurt office specializing in national and international matters of public procurement law, privatizations, public private partnerships (PPP) and regulatory compliance.

Dr. Braun regularly advises public sector authorities, such as federal agencies and municipalities, in structuring complex public acquisition processes, predominantly in the area of IT. He is also experienced in litigating procurement matters on behalf of public sector institutions or private sector companies before review chambers in Germany. Dr. Braun’s practice includes extensive experience in assisting clients in developing effective strategies for participating in tender procedures worth more than 2 billion Euro in total.

Dr. Braun has published widely in the area, advised on the implementation of EU Public Procurement Law and is a regular speaker on national and international conferences and training seminars on the subject. The following are some of his more notable engagements:

  • Defending a client before the World Bank Sanctions Board against allegations of corrupt practices in World Bank procurement, advising vis-á-vis international financial institutions (EBRD, EIB, EU, et al.) to avoid debarment and cross-debarment and on a structured disclosure of past misconduct.
  • Chamber of Commerce Frankfurt am Main on various procurement procedures.
  • Stadt Kassel on an innovative inner-city bike hire scheme.
  • Advising a Pharma company in the contract award procedure of a health insurance fund.
  • Representing a multi-national diagnostics company in review procedure before the federal review chamber.
  • Federal Ministry of Finance on a complex IT-project.
  • Ministry of Finance of Hesse on four complex PPP projects, which comprised the design, financing and private operation of agencies for ground management (project volume €40 million).
  • Land Saxony-Anhalt on the award of an IT-contract for the introduction of a Personnel Management System (PROMIS).
  • Various clients in conducting internal investigations, setting up codes of ethics and general compliance matters.
