IP/IT and Data Privacy

Orrick’s experts for industrial legal protection enjoy internationally an excellent reputation. More than 150 lawyers command professional knowledge, a high degree of technical expertise and also comprehensive and practical experience in advising.

Orrick advises both companies in the technology sector and in other sectors comprehensively, such as advising in the field of industrial legal protection (competition law, trademark law, copyright and design law), IT and data privacy law.

We advise and represent clients regarding trademark infringement before the courts, including trademark counterfeiting, product piracy and unfair trade practices, as well as registrations at authorities. Our lawyers regularly draft and negotiate contracts to sell, buy or license software and hardware.

Additionally, we advise on matters regarding data privacy law as well as on requirements of internet legislation, such as long-distance transactions law or domain law. In data privacy law we support comprehensively, often starting with a first risk analysis in order to recognize particularly urgent fields of action. Subsequently we continue with a draft of contracts or company agreements to deal with personal data. We also regularly represent our clients when dealing with data protection supervisory authorities. One key focus in our counselling lies in support during international data transfer, e.g. within a consortium, or to foreign authorities, cloud computing, the introduction of BYOD or the outsourcing of services in general.

We also conduct IP/IT due diligence proceedings and advise on related issues in the context of mergers and joint ventures.
