Chances and limits of competition

Counseling on competition law starts at the very beginning of M&A projects: Orrick Hölters & Elsing plans and handles merger control proceedings with the German Federal Cartel Office and the European Commission, and coordinates worldwide merger control proceedings. Furthermore, Orrick Hölters & Elsing counsels and represents clients in all other competition law issues and proceedings – from representation in fines and abuse proceedings to strategic counseling on new corporate concepts.

In the area of state aid law, Orrick Hölters & Elsing counsels in particular regarding the application for state aid and the structuring of state aid measures to ensure compatibility with the Common Market. One focus is the representation in court proceedings, in which the public bodies or a competitor of the beneficiary seek to ensure the recovery of illegal state aid. Presently this applies in particular to the energy and the transportation sector.
